Item Shop Terms of Use

· Article 1 [Objective]

The purpose of these terms of use shall be to provide, between Lizard Interactive (hereinafter referred as “Company”), developer and service provider of MMORPG (Massively Multiplayer Online Role Playing Game) Cronous (hereinafter referred as “Service”) and the user (hereinafter referred to as “User(s)”) of the Services, the basic terms and conditions regarding purchase and user of game point (cyber currency). Therefore, the Company and the Users shall be obliged to confirm these terms of use from time to time and also to be in strict compliance with the same.

· Article 2 [Validity and Amendment]

1. Change in important provisions hereof concerning rights or obligations of Users will be notified on the Cronous website     (www.cronous.com).
2. Company is entitled to change this agreed provisions in all or in part if any reasonable cause occurs therefore.
3. User shall be deemed to agree with these agreed provisions by visiting Cronous website (www.shoonline.net) and     confirm updated or notified matters regularly. Company shall not be held responsible for damages sustained due to     user’s failure of such confirmation in any case.
4. User is entitled not to agree with these agreed provisions. If user does not agree with this agreed provisions or     changed agreed provisions, it may be temporarily suspended or deprived of its entitlement of service use. Provided     that, if user fails to express its intention of disagreement within 7 days from the effective date of change of this agreed     provisions, it shall be deemed to agree with the changed agreed provisions.

· Article 3. [Definition of Terms]

1. “Partially Paid Service (hereinafter ‘Partially Paid Service)” means procuring act of Pay Item using Item Shop in Cronous     game client, and purchasing cyber money Point, at the Cronous website (www.cronous.com) in order to use Item Shop.
2. “Item Shop (hereinafter ‘Item Shop’)” means NPC which sells cash Item in Cronous game client in exchange of Points.
3. “Point (hereinafter ‘Point(s)’)” means cyber money which user purchases through various payment methods provided     at the Cronous website (www.cronous.com) in order to avail “Partially Paid Service”.
4. “Pay Item (hereinafter ‘Pay Item(s)’)” means an item which can be procured through Item Shop NPC in Cronous game     client, differing from free item basically provided in Cronous.
5. “Partner (hereinafter ‘Partner(s)’)” mean associated companies of Company which provide payment solution for      Partially Paid Service.

· Article 4 [Partially Paid Service Fee]

1. Detailed amount and payment method of using fee of Partially Paid Service shall follow as notified separately by     Company through its homepage.
2. Damages or refund with regard to using fee of Partially Paid Service shall be dealt with under provisions of Chapter 5     ‘Indemnity and Refund’ of Terms of Use.

· Article 5 [Use of Item Shop]

1. User shall enter all information required in Cronous registration page.
2. All information entered by User shall be accurate and Company shall assume this information to be true.

· Article 6 [Protection of Personal Information]

1. Company shall use personal information of User only for providing the service specified in this agreement and shall not    disclose personal information to a third party without prior consent from the User. Provided that, personal information    may be disclosed in the following cases:
    (1) If concerned government agency requires personal information as part of criminal investigation under the law;
    (2) If government agency or judicial authority requires personal information through procedures under the relevant law

2. Other matters concerning protection of personal information shall follow
   ‘Private Policy’ of the Company.

· Article 7 [Guide for Point Use]

1. Only Cronous member may purchase Point.
2. User shall read guide for payment prior to making actual payment on Cronous website (www.cronous.com). Company     shall not be held responsible for damages relating to payment made without reading guide for payment.
3. Change in payment options and payment method will be notified at Cronous website (Www.cronous.com).
4. Payment service may be suspended in all or in part temporarily due to situation of Payment Solution Provider or     between Company and Payment Solution Provider.
5. Point can be used only for procurement of Pay Item in Cronous game client (within game).

· Article 8 [Point Purchase]

1. Only Cronous member may purchase Points.
2. Point shall be purchased by means of credit card, and other payment solutions listed at Cronous website     (www.cronous.com) only. Payment options and/or methods may be changed without prior notice.
3. Maximum amount of purchase per account for every month is US$ 500 (Five hundred US Dollars).
3. User is considered to have agreed to respective agreement and provisions of Company and of each Partner company. 4. US1 dollar is exchanged with 100 points.

· Article 9 [Refund]

1. If Cash item purchased with points has been used in anyway by the user, It is no longer the subject for its refund.     Lizard Interactive review the conditions of refund only for the Items which has not been used.
2. User may ask to refund using fee within 10 days. In this case, after making request for, User shall send materials     proving actual payment conforming to requirements stated by corresponding payment solution provider. With materials     of proof of payment, User shall indicate game name, game account name and payer name accurately, enabling     confirmation thereof to be made.
      (1) Payment by credit card: invoice for card and statement in corresponding month
      (2) Payment solutions listed and provided at Cronous website (Www.cronous.com).

3. In case of overpayment made by User, Company shall refund exceeding amount within the prescribed time upon    request of User customer for refund.
4. If User asks for refund mentioned in above section 1, have submitted completed materials of proof of payment and if     details are confirmed, Company shall make refund on the specified time by Company (Every Monday).
    User shall receive refund with processing fee and service charge of Payment Solution Provider already deducted.
      (1) PayPal: 15% in case of payment by credit card
      (2) Click & Buy: 7 Euro per case
      (3) Credit card (Cyber pass): 15%
      (4) Other payment solutions added in the future follows the company regulation set accordingly on service charge            deduction rate.
5. In case of delay of refund due to a cause attributable to User, Company shall not be held liable for any damages.

    User may be required to pay fee in using certain particular service or services. User agrees to pay such fee.
    Unless otherwise indicated, currency of all amounts is in US$. Company reserves its right to change amount of price,
    fees and/or basis of its calculation and if such change occur, Company will notify through Cronous webpage     (www.cronous.com). Such change shall be effective only for payments made after application thereof.

   If any objection is raised or any dispute occurs with regard to Partially Paid Service of Company, Company may close    the corresponding account at its own discretion without any prior notice.

   User shall be held solely responsible for all charges made to own account, including unauthorized fee.

   Company may modify, amend or supplement using fee or invoicing means from time to time, and such change will be    notified through this agreement or Cronous website (www.cronous.com), and it shall be effective immediately.

· Article 10 [Jurisdiction and Governing Law]

1. The lawsuit relating to a conflict arising between the Company and a User in relation to the use of Service shall be     submitted to the competent court under the Civil Procedure.
2. The company reviews the conditions of refund only for the Items which have not been used by the player. As for the     manipulation of refund which violates the terms listed in this agreement, the company holds right to take legal action     to reclaim damage caused by the user.
3. Since an active cooperation to an investigation of criminal offense is a policy of the Company, in case of any relevant     request, the Company may disclose all the information, including but not limited to, the pursuit of personal Information     relating to IP address and any other Information of a User in the file to the applicable governmental authority.
4. The lawsuit rose between the Company and a User shall apply the law of the Republic of Korea.
